感謝lukhnos的第一手消息(Le Monde)，我讀不懂法文，所以去找了英文新聞，有”French Parliament Votes to Allow Web File Sharing “(via Bloomberg News)和”France may sanction unfettered P2P downloads” (via Cnet)。
而法國的這個案子,需要政府主動或是經由上議院才能封殺。
The amendment, which is attached to a bill on intellectual property rights, states that “authors cannot forbid the reproduction of works that are made on any format from an online communications service when they are intended to be used privately” and not for commercial use.
這個在智慧財產權修訂法下的法案明確的指出「如果用於私人還有非商業行為，作者不能禁止網路社群複製該作者作品成任何形式下(散佈)」
雖然因為靠近假期，出席率出奇的低，577個的眾議員裡，只有58個出席。是一個比數很近的投票，30比28。這提醒我了當初Sony Betamax在美國最高法院，最後5比4的票數。很驚險。
另外比較明確的規定，像是要ISP把他們的部份盈餘，交給一個專門處理創作者版稅的機構（Sacem）。這類似之前美國有人提出，要mp3硬體製造商加個費用給娛樂產業。這是一個指標性的法案。因為美國法律基本上只能用合理使用(fair use)的理由能夠光明正大的違反著作權法，而有爭議的fair use則要經過法院的裁定，所以在侵權(copyright infringement)上有很多灰色地帶。
